These Terms of Service (hereinafter the "Terms") govern access to and use of the Xnovate online store and all associated services (hereinafter the "Services").
By accessing the Services or placing an order, you agree to be bound by these Terms. If you do not accept them, you must not use the Services.

1. Access and Account

Access to the Services may require creating a user account. You must provide accurate, complete, and up-to-date information.
You are solely responsible for the confidentiality of your login credentials and for all activity carried out through your account.
You may not transfer, assign, or authorize the use of your account by a third party.
By using the Services, you represent that you have reached the legal age required to enter into a contract in your jurisdiction.

2. Products

Descriptions, photographs, 3D renderings, visuals, or technical information available on the Services are intended to represent the products as accurately as possible. However, because 3D renderings are digital models, slight variations may exist between the representation shown and the final product, due to technical constraints inherent to 3D rendering or to the display equipment used (devices, screen settings, brightness, calibration, etc.).
These differences do not constitute a breach of contract.

Xnovate strives to ensure the reliability of the information presented but cannot guarantee that the appearance, colors, or certain visual details will be strictly identical under all display conditions.

Xnovate reserves the right to modify, update, or withdraw any product, feature, or information, without notice and at any time.

3. Orders

Any order placed constitutes an offer to purchase.
Xnovate reserves the right to accept or refuse any order, in particular in cases of suspected fraud, incorrect information, inability to process the order, or product unavailability.

An order is considered accepted only after confirmation by email.
Orders are processed after payment is received and validated.

Purchases are subject to Xnovate's Refund Policy.

Products are intended for personal or household use and may not be purchased for commercial resale without prior written authorization.

4. Pricing, Billing, and Payment

The prices displayed at the time of the order are binding.
Unless otherwise stated, they exclude taxes, shipping costs, import duties, or any additional fees that may apply depending on the destination country.

You agree to provide accurate, complete, and up-to-date payment information.
By placing an order, you warrant that you are authorized to use the payment method provided and have the necessary funds available.

5. Shipping and Delivery

The delivery times communicated are indicative.
Xnovate is not responsible for delays caused by carriers, logistical incidents, customs constraints, or events beyond its control.

Risk transfers at the time the product is physically taken into possession by the customer or by a third party designated by the customer, other than the carrier, in accordance with Article L216-4 of the French Consumer Code (Code de la consommation). In the event of loss or damage to the parcel during transport, the customer must contact Xnovate, which will take the necessary steps with the carrier.

6. Intellectual Property

All content present on the Services (text, images, videos, logos, graphics, designs, technical files, audiovisual materials, etc.) is protected by applicable intellectual property laws and is the exclusive property of Xnovate or its partners or suppliers.

Any reproduction, modification, distribution, commercial use, or unauthorized use is strictly prohibited.

No right or license is granted to you, except with prior written authorization.

7. Third-Party Tools and Services

Certain tools or features offered through the Services may come from third-party providers.
These tools are provided "as is," without warranty.
Xnovate cannot be held liable for their operation, availability, or accuracy.

Any use of third-party tools is at your own sole responsibility.

8. External Links

The Services may contain links to sites operated by third parties.
Xnovate is not responsible for the content, policies, products, or services of such sites.
Any interaction or transaction with a third party is solely a matter between you and that third party.

9. Relationship With Shopify

The Services are hosted and powered by Shopify.
However, any transaction takes place between you and Xnovate.
Shopify bears no responsibility whatsoever for sales, products, disputes, or claims related to your purchases.
By using the Services, you agree to release Shopify from any liability relating to transactions carried out on the Xnovate store.

10. Privacy Policy

The collection and processing of your personal data are governed by the Privacy Policy available on the store's dedicated page.
Hosting by Shopify also involves certain data collection and processing carried out by Shopify, in accordance with its own privacy policy.

11. Feedback

Any suggestion, review, idea, or feedback voluntarily submitted to Xnovate may be freely used for any purpose, including commercial purposes.
You warrant that you hold the necessary rights to submit such content.

12. Errors, Inaccuracies, and Updates

The Services may contain errors or omissions.
Xnovate reserves the right to correct, modify, or update any content without notice, including after an order has been placed.
In the event of an obvious error, Xnovate may cancel or refuse the related order.

13. Prohibited Uses

You agree not to use the Services for purposes that are:

illegal or fraudulent
infringing on intellectual property rights
harmful to the security or operation of the site
distributing harmful, threatening, or unlawful content
attempting unauthorized access to Xnovate's or Shopify's systems

Any violation may result in the immediate termination of your access to the Services, without compensation.

14. Termination

Xnovate may suspend or terminate access to the Services, at any time and without notice, in the event of non-compliance with these Terms.
Financial or legal obligations incurred prior to termination remain applicable.

15. Disclaimer

The Services and all products are provided "as is" and "as available."
Xnovate makes no express or implied warranty, including with respect to availability, compatibility, accuracy, or freedom from errors.

Certain limitations may not apply depending on local law.

16. Limitation of Liability

To the extent permitted by law, Xnovate shall not be held liable for:

indirect, incidental, or consequential damages
financial losses, data loss, or loss of business
damages resulting from improper or non-compliant use of the products
decisions made by carriers or external service providers

Xnovate's total liability shall not exceed the amount paid for the order in question.

17. Indemnification

You agree to indemnify and hold Xnovate harmless from any claim or damage arising from:

a breach of these Terms
your use of the Services
any unlawful or unauthorized action carried out through your account

18. Severability

If any provision is declared invalid, it will be applied to the extent permitted by law.
The remaining provisions shall remain fully applicable.

19. Waiver and Entire Agreement

Failure to enforce any provision shall not constitute a waiver.
These Terms constitute the entire agreement between you and Xnovate.

20. Assignment

You may not assign your rights or obligations without prior written authorization.
Xnovate may freely transfer or assign these Terms.

21. Governing Law

These Terms are governed by French law.
Any dispute shall fall under the jurisdiction of the courts having authority over Xnovate's registered office.

22. Changes to the Terms

Xnovate may modify these Terms at any time.
The update date will be indicated.
Continued use of the Services constitutes acceptance of the changes.
